Dua orang Islam minum arak didenda RM5,000, sebat 6 kali
KUANTAN 12 Jan. – Mahkamah Tinggi Syariah di sini hari ini
menjatuhkan hukuman denda RM5,000 dan sebatan enam kali mengikut
syariah ke atas seorang lelaki dan seorang wanita yang mengaku
bersalah meminum arak.
Hakim Datuk Abdul Rahman Yunus menjatuhkan hukuman itu selepas kedua-
dua tertuduh, Mohd. Nasir Mohamad @ Sulaiman, 38, dan Noorazah
Baharuddin, 22, mengaku melakukan perbuatan yang dilarang oleh agama
Islam itu.
Mohd. Nasir dituduh meminum arak jenama Tiger Beer di Fun Pub,
Holliday Villa, Cherating, pada kira-kira pukul 11.37 malam, 11 Julai
2008. Dia telah berkeluarga dan mempunyai empat orang anak, bekerja
dengan sebuah syarikat perkapalan di Kemaman, Terengganu.
Sementara Noorazah yang bekerja sebagai seorang pelayan di sini,
dituduh meminum arak jenama Heineken di Black Forest Pub, Jalan
Gambut dekat sini kira-kira jam 1.20 pagi pada 12 Julai 2008.
Kedua-dua tertuduh didakwa melakukan kesalahan di bawah Seksyen 136
Enakmen Pentadbiran Ugama Islam Dan Adat Resam Melayu Pahang 1982 dan
dihukum di bawah Seksyen 4 Enakmen Pentadbiran Agama Islam Dan Adat
Resam Melayu Pahang (Pindaan) 1987.
Enakmen tersebut turut memperuntukan hukuman penjara sehingga tiga
tahun.
Pelaksanaan hukuman sebat dibuat mengikut Seksyen 125 Enakmen
Tatacara Jenayah Syariah 2002.
Dalam penghakimannya, Hakim Abdul Rahman berkata, sungguhpun kedua-
dua tertuduh tidak dikenakan hukuman penjara, namun jumlah denda yang
tinggi dan sebatan yang dikenakan diharap dapat menginsafkan mereka
mengenai kesalahan yang dilakukan.
Mengenai hukuman sebat pula, Hakim Abdul Rahman berkata, ia bertujuan
bukan untuk menyeksa, tetapi hendak memberi pengajaran dan perasaan
malu kepada diri tertuduh.

‘Syariah’ rotan, fine for man and waitress who had a beer
KUANTAN: A father of four and a waitress were fined RM5,000 each and
ordered to be given six strokes of “syariah” rotan each for consuming
alcohol in entertainment outlets, here, last year.
If they do not pay the fine, they will be jailed three years.
It is the second time the Syariah High Court judge meted out such a
sentence after two brothers received a similar sentence in 2005.
On Dec 1 last year, Mohd Nasir Mohamad @ Sulaiman, a 38-year-old
shipping company staff from Kemaman, and Noorazah Baharuddin, 22,
from Selangor, pleaded guilty to consuming alcohol in July last year.
Nasir admitted that he drank Tiger beer at a pub in Cherating at
11.37pm on July 11, while Noorazah consumed Heineken beer at a pub,
where she worked in Jalan Gambut here at 1.20am on July 12.
Judge Datuk Abdul Rahman Yunus said he must give the maximum fine and
rotan as a deterrent to the accused and others.
However, he said, both of them were spared from the three years’ jail
as he believed that such a sentence would bring difficulty to their
families.
Abdul Rahman also explained that the “syariah” rotan was different
from caning as it had to follow the Syariah Criminal Procedure
Enactment 2002.
“The caning is to shame them and should be done at any of the prisons
in the country.”
Both the accused were not represented, while Syariah deputy public
prosecutor Saiful Adham Sahimi was prosecuting.
The accused have 14 days to appeal against the decision.
Another accused, part-time model Kartika Sari Dewi Shukarno, 32,
would know her fate on May 4.
Kartika, who holds a permanent resident status of Singapore, could
not come to the court as he was still studying in the republic.
State head of Syariah prosecution Datuk Abdul Rahim Jaafar, when met
after the case, explained that the syariah caning on the two brothers
had yet to be executed in Pahang as their appeal was pending.
The sentence for consuming alcohol was made stiffer when the Islamic
Religious Administration and Pahang Malay Tradition Enactment 1982
was amended in 1987.
Under Section 136 of the enactment, those who were found guilty could
be fined up to RM5,000 or jailed a maximum of three years or both,
and receive six strokes of Syariah rotan.
Abdul Rahim said there were several criteria for the caning and
the “rotan” should be a seamless cane or branch that was not more
than 1.22m long and 1.25cm thick.
At the same time, he said, the offenders were allowed to wear their
clothes and the punishment should not break their skin.
